User Service Agreement

Foreword

Welcome to visit plugos. Net (hereinafter referred to as the “Platform”), which is operated and managed by [Shenzhen Pingbo Information Technology Co., Ltd.] (hereinafter referred to as “We”). This User Service Agreement ( hereinafter referred to as the “Agreement”) is a legally binding contract between you (hereinafter referred to as the “ User”) and us with respect to the product promotion, product sales, after-sales support and other related services ( hereinafter collectively referred to as the “Platform Services”) provided by using the Platform. Please carefully read and fully understand all the terms of this agreement before using the service of this platform, especially the terms concerning the exemption or limitation of our liability, the limitation of user rights, and the agreement of dispute resolution (the relevant terms will be highlighted in bold). Your actual use of this platform service means that you have fully understood and accepted all the contents of this agreement, voluntarily established a service relationship with us, and agreed to be bound by this agreement. If you do not agree to any of the terms of this Agreement, do not use the Platform Services.

1. Service Scope and Description

1.1. Service content:

Product promotion service: The platform will show users the functional features, technical parameters, usage scenarios, price information and preferential activities of PlugOS series products (including but not limited to hardware devices, software tools, supporting accessories, etc., hereinafter referred to as “platform products”) through graphics, video, live broadcast, product manual download and other forms. To ensure that the publicity information is true, accurate and complete, without false publicity or misleading description; at the same time, to provide users with product consulting services, through online customer service, consulting hotline and other channels to answer users’ questions about product performance, adaptation scenarios, purchase instructions and so on.

Product sales service: The platform provides users with online purchase channels for platform products. Users can complete operations such as product browsing, adding to the shopping cart, submitting orders, and making payments through the platform (purchase information needs to be filled in accurately when purchasing); According to the user’s order information, we will coordinate with the warehousing and logistics partners to deliver the goods to the address designated by the user according to the agreed time (the specific delivery scope and time limit are subject to the delivery policy); at the same time, we will provide order management services, and the user can submit an application through the service form, such as inquiring the delivery progress, canceling the undelivered order, etc.

After-sales support services: The platform provides product use guidance services to help users solve operational problems encountered in the process of product use through video tutorials, graphic manuals, online customer service remote assistance, etc. At the same time, it provides after-sales service for orders, and users can submit applications through service forms, such as maintenance, replacement, etc.

The specific service content is subject to the real-time display on this platform. We have the right to optimize, update or adjust the service content according to the technical development, market demand and operation planning, and notify users by subscribing to the email.

1.2. Service Limit:

The user shall have the capacity for civil conduct in accordance with the laws and regulations. If you are a person without capacity for civil conduct or a person with limited capacity for civil conduct, you shall read this Agreement accompanied by the legal guardian and obtain the consent of the guardian before using the platform products to purchase services; This platform service is only for users who use it legally and in compliance with regulations. Users are prohibited from using the platform service to engage in malicious orders (such as cancellation after batch orders, false orders), reselling platform products, disseminating false after-sales information, falsely reporting product failures to defraud refunds and other acts in violation of laws and regulations or this agreement. We have the right to restrict or terminate the service for illegal use.

1.3. Third-Party Services:

This platform may include services provided by third parties (such as payment channels, logistics distribution, third-party quality inspection services, etc.). Such third-party services are independently operated by third parties, and their terms of service and privacy policies are formulated by third parties. We are not responsible for the security, legality, accuracy and quality of third-party services (such as payment delays, logistics distribution delays, etc.). Users shall check and abide by the relevant regulations of the third party when using the third party service; if the user’s rights and interests are damaged due to the third party service problem, the user can negotiate with the third party to solve the problem, and we can provide necessary assistance.

2. Purchase Information Management

2.1. Purchase information provided:

When purchasing products on this platform, users shall provide true, accurate, complete and valid purchase information, including but not limited to the name of the consignee, contact number, detailed receiving address, e-mail (if electronic invoice is required), etc.; If the purchase information provided by the user is false, wrong, incomplete or invalid (such as the contact telephone number is empty, the receiving address is vague), it may lead to problems such as the order can not be generated normally, the payment fails, the goods can not be delivered or the after-sale application can not be passed, resulting in the cancellation of the order, the delay in distribution, and the return of the goods. We have the right to refuse to process the relevant orders or after-sales applications according to the actual situation.

2.2. Verification and modification of purchase information:

We have the right to verify the rationality of the purchase information provided by the user after the order is generated and before the goods are delivered (such as contacting the user to confirm the receiving address, checking the consistency between the payment information and the order information). If the information is found to be abnormal (such as a large number of orders from different addresses generated in a short time by the same mailbox or the same receiving address), we can suspend the order processing and notify the user to supplement the information. Users need to cooperate with the verification within 24 hours after receiving the notice. If they fail to cooperate within the time limit, the order will be cancelled automatically; After the order is generated, the user can apply to modify the receiving information (including the consignee, contact phone number and receiving address) before the goods are delivered. The user needs to contact the customer service and provide the order number + reserved email address to verify the identity before applying for modification. After the goods are delivered, due to the limitation of the logistics link, the consignee and contact phone number cannot be modified. The specific rules of the logistics partner shall prevail.

2.3. Purchase information storage and protection:

In accordance with the Privacy Policy, we will encrypt and store the user’s purchase information, which will only be used for order performance (such as logistics distribution), after-sales support (such as goods return and exchange), invoice issuance and other scenarios directly related to the purchase behavior, and will not be used for other unrelated purposes; The user’s purchase information will be retained for 12 months after the completion of the order (from the date of confirmation of receipt), and will be anonymized or deleted in accordance with the privacy policy. If the user needs to query the historical order, the order number and reserved mailbox verification shall be provided within the retention period; We will take technical measures (such as data encryption, access control) and management measures (such as internal permission approval) to protect the security of the user’s purchase information and prevent the disclosure, loss or tampering of the information. We will not be responsible for the disclosure of the purchase information not caused by our intention or gross negligence (such as the user’s disclosure of the order information to a third party).

3. Code of Conduct for Users

Users shall strictly abide by the Constitution of the People’s Republic of China, the Law of the People’s Republic of China on Network Security, the Law of the People’s Republic of China on the Protection of Consumer Rights and Interests, the Law of the People’s Republic of China on Electronic Commerce and other relevant laws, regulations and policies when using the services of this platform, and shall not commit the following acts:

  1. Upload, publish and disseminate information containing words, pictures, videos and links that endanger national security, undermine national unity, promote terrorism, extremism, pornography, violence, gambling, defamation, insult others and other illegal and illegal contents that violate public order and good customs, or publish malicious remarks and false evaluations unrelated to products in the product evaluation area;
  2. Infringement of other people’s intellectual property rights (including copyright, trademark rights, patent rights, trade secrets, etc.), privacy rights, reputation rights, portrait rights and other legitimate rights and interests, such as embezzlement of other people’s order information, disclosure of other users’purchase information (such as receiving address, contact telephone);
  3. Attack, invade, interfere with and destroy the server and network system of the platform, or use technical means to bypass the payment and order verification mechanism of the platform, and implement malicious orders, bill-brushing and preferential treatment, which affect the normal operation of the platform service;
  4. Submit orders with false identities or false information, or forge or tamper with order data or after-sales vouchers to defraud the platform of preferential rights, refunds or compensation;
  5. Use this platform service to engage in pyramid selling, fraud, money laundering, illegal financing and other illegal and criminal activities, or sell counterfeit and inferior products, prohibited goods (such as state-controlled goods, dangerous goods, etc.);
  6. Other acts that violate laws and regulations, this agreement or damage the legitimate rights and interests of this platform and other users. If the user violates the above code of conduct, we have the right to take measures such as warning, deleting the illegal content, restricting the purchase function (such as prohibiting the submission of new orders), canceling the order, refusing the after-sales application, and permanently restricting the use of platform services according to the severity of the violation, and have the right to report to the relevant regulatory authorities; If the user’s violation causes losses to the platform (such as compensation for third parties, administrative fines, etc.) Or affects the rights and interests of other users, the user shall bear full liability for compensation.

4. Intellectual Property

4.1. Platform Intellectual Property:

The intellectual property rights of all the contents of this platform (including but not limited to website design, page layout, product promotional materials, text introduction, pictures, videos, icons, logos, software programs, data information, etc.) are owned by us or the relevant obligees, and are protected by the Copyright Law of the People’s Republic of China, the Trademark Law, the Patent Law and other laws and regulations; The design drawings, technical parameters and promotional videos of the platform products shall not be used for commercial purposes without permission; Without the written permission of us or the relevant obligee, any user shall not copy, reproduce, disseminate, modify, adapt, compile, translate, distribute, rent, exhibit, perform the content of this platform, or use it for other commercial purposes (such as using the platform product promotional map for other brand promotion).

4.2. Intellectual Property of User Uploaded Content:

The intellectual property rights of the product evaluation, use feedback, list pictures and other contents uploaded and published by the user through this platform (hereinafter referred to as “user content”) belong to the user or the original obligee; Users agree to grant us a worldwide, free, non-exclusive, sublicensable and sub-licensable right of use, including but not limited to: displaying and disseminating user content on this platform and our affiliated platforms (such as using high-quality pictures for product promotion); Perform necessary format conversion and optimization on user content (such as adjusting the image size to adapt to the display scene); perform data analysis and statistics based on user content for platform service optimization and product development (the statistical data will be anonymized, excluding the user’s personal identity information); Users guarantee that the user content they upload has no intellectual property defects, does not infringe upon the legitimate rights and interests of any third party, and that the content is true and objective (for example, product evaluation should be based on actual use experience, and should not contain false publicity or malicious defamation content). If the user’s content infringes the third party’s intellectual property rights or other legitimate rights and interests, the user shall bear all the responsibilities, and if it causes losses to us (including but not limited to compensation, litigation costs, attorney fees, etc.), the user shall compensate in full.

4.3. Intellectual Property Protection:

If any third party believes that the user’s content or the content of this platform infringes its intellectual property rights, it can submit written complaint materials to us through the official customer service channel of this platform ( including the identity information of the complaining party, the ownership certificate, the specific location of the infringing content and the reasons for infringement). After receiving the valid complaint, we will check it in accordance with the relevant laws and regulations and the rules of the platform. According to the verification results, measures such as deleting the infringing content and suspending the relevant user services shall be taken, and the results shall be notified to the complaining party and the complained party.

5. Privacy Protection

We attach great importance to the protection of users’ privacy, and will collect, use, store and protect users’ personal information (including purchase information, payment information, etc.) in accordance with the Privacy Policy ( hereinafter referred to as the “Privacy Policy”). The Privacy Policy is an important part of this Agreement and has the same legal effect as this Agreement. Users should carefully read and understand all the contents of the Privacy Policy before using the services of this platform. If users do not agree with the provisions of the Privacy Policy, they should immediately stop using the services of this platform.

6. Service Change, Interruption and Termination

6.1. Service Change:

We have the right to change the functions, contents and charging standards (such as product prices and preferential activity rules) of the platform services according to the technical development, market demand and operation planning ( such as adjusting the after-sales service Warranty period, update of logistics partners), and notify users in advance by subscribing to emails (if product price changes are involved, they will be publicized at least three working days in advance). Optional if the user does not agree with the changed service content Choose to stop using the service of this platform (such as cancel the unpaid order), if the user continues to use, it will be deemed to accept the service change.

6.2. Service interruption:

Due to force majeure (such as natural disasters, wars, policy adjustments, etc.), third-party service failures (such as payment system failures, logistics outages), system maintenance upgrades, user violations and other reasons, it may Cause the service of the platform to be temporarily interrupted (such as the closure of the order payment channel and the maintenance of the after-sales application system). We will try our best to reduce the service interruption time within a reasonable range, and timely inform users of the reasons for service interruption through platform announcements and other means.

And recovery time (except for service interruptions caused by user violations). If the direct loss caused to the user due to service interruption is caused by our intentional or gross negligence, we will bear the corresponding liability for compensation according to the actual situation (such as the reasonable loss caused by order delay); if it is caused by force majeure, third party reasons or the user’s own reasons, we will not be liable.

6.3. End of Service:

If the user actively applies for the termination of the use of the platform service (such as cancellation of the order), the application shall be submitted in accordance with the procedures specified by the platform (the identity verification and the processing of the unfinished order shall be completed). After verifying the user’s identity and account status, we will handle the relevant procedures for the user. Relevant data (including order records, purchase information, etc.) will be processed in accordance with the Privacy Policy;

If the user violates this agreement and fails to correct after being warned by us, or the violation is serious (such as engaging in fraudulent activities, refusing to pay after placing a large number of malicious orders), we have the right to unilaterally terminate the provision of all or part of the platform services to the user (such as prohibiting the use of the purchase function, refusing to process after-sales applications), and do not need to assume any liability for compensation to the user;

If we need to terminate the provision of platform services due to business adjustment, cessation of operation and other reasons, we will notify users 30 days in advance by means of platform announcement and subscription email, and provide users with after-care services such as refund of undelivered orders, transfer of after-sales guarantee of purchased products (such as entrusting a third party to handle subsequent after-sales). The specific matters shall be subject to the content of the notice.

7. Disclaimer

The platform will try its best to ensure the authenticity and accuracy of the product publicity information. However, due to the rapid iteration of product updates, if there is a slight difference between the publicity content and the real object (such as the adjustment of product color matching and accessory details), the real object shall prevail, and we will not assume the responsibility arising therefrom;

Before purchasing the product, the user should carefully read the information on the product details page. If you have any questions, you can contact the customer service for confirmation. The user shall bear the misunderstanding or loss caused by the user’s failure to confirm the information carefully. The platform will try its best to ensure the stability and security of the platform service, but it does not guarantee that the platform service is flawless and fault-free, nor does it guarantee that there is no delay in order processing, payment and settlement, logistics and distribution, etc. If the platform service has problems or the order performance is delayed due to technical limitations, network attacks, system failures, logistics peak periods and other reasons, we will repair or coordinate to solve them in a timely manner within a reasonable range, but we will not be responsible for the indirect losses caused to users (such as commercial losses caused by the failure to deliver products on time).

The quality of platform products conforms to relevant national standards and industry standards, but the damage or failure of products caused by improper use by users (such as use beyond the applicable scenarios of products, unauthorized disassembly and maintenance) is not within the scope of after-sales protection, and we are not liable for maintenance or compensation;

The user shall use the product correctly according to the product instructions. If personal or property damage is caused by improper use, the user shall bear the responsibility on his own.

8. Modification and Interpretation of the Agreement

Change of Agreement: We have the right to modify the contents of this Agreement according to the update of laws and regulations, policy adjustment, platform operation needs, etc. The revised agreement will be marked “Update Date” and the revised agreement will be effective from the date of publication. If the user does not agree with the modified agreement, the user shall immediately stop using the service of this platform; if the user continues to use the service of this platform, it means that the user accepts the modified agreement.

Agreement Interpretation: The formation, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China (excluding conflict of laws rules). If any provision of this Agreement is deemed invalid or revocable due to violation of laws and regulations or by the competent authority, the validity of other provisions shall not be affected, and other provisions shall continue to be performed.

9. Dispute Resolution

In case of any dispute (such as order dispute, after-sales dispute, etc.) between you and us arising from this Agreement or the platform services, it shall be settled through friendly negotiation first;

If the negotiation fails, either party has the right to bring a lawsuit to the people’s court with jurisdiction in the place where the operating subject of the platform is located.

In the process of dispute resolution, except for the disputed matters, other terms of this Agreement shall continue to be performed (such as the performance of the products that have been ordered and the after-sales application that is being processed).

10. Others

This Agreement shall come into effect from the date when the user actually uses the platform services (such as browsing products and submitting orders), and shall be valid until the date when the user terminates the use of the platform services or the platform ceases to operate.

Matters not covered in this Agreement shall be subject to the Privacy Policy, the Rules for Return and Exchange of Goods after Sale, the Delivery Policy and other relevant rules issued by this Platform; in case of any conflict between this Agreement and the above rules, this Agreement shall prevail.
